California forces smokers into their homes
Secondhand smoke declared public nuisance

CALABASAS, Calif. (AP) — No more smoking in the park. Lighting up on the sidewalk could bring a fine. Dining on the restaurant patio? Don’t bother asking for matches.
One of the strictest tobacco bans in the United States went into effect in the Los Angeles suburb of Calabasas last week, making smoking off limits in public places where someone else might be exposed to secondhand smoke: indoor businesses, outdoor businesses, parks, outdoor cafes, apartment building common areas.

“We just don’t want anyone blowing smoke in someone’s face,” said Mayor Pro Tem Dennis Washburn. “Unfortunately, what smokers do is harmful to everybody else. People should have the right to breathe clean air.”

California air-quality regulators declared secondhand smoke a toxic air pollutant earlier this year.

The city took it a step farther, declaring secondhand smoke to be a public nuisance and approving an ordinance banning smoking in all public places — indoors and out — where people might congregate.

Hotels can still allow smoking in up to 20 per cent of their rooms, and smoking can be allowed in approved designated areas at shopping malls and work places in the upscale city of 23,000 residents.

But if a nonsmoker asks a smoker to stop, the smoker must snuff it or face a possible fine in the hundreds of dollars or even a lawsuit.

“We salute Calabasas for raising the bar,” said Jim Knox, a legislative advocate for the American Cancer Society in Sacramento. ``Smoke regulations can play a very important role in reducing public exposure to harmful secondhand smoke.”

Nationally, hundreds of U.S. cities and several states restrict smoking.

In California, where communities have been at the forefront of smoking bans, San Francisco banned smoking in parks and stadiums last year, and oceanfront communities’ smoking bans have inspired others in Florida and Delaware to designate smoke-free beaches.

Among the states, Colorado legislators approved a statewide ban on smoking in most public building last week, and New Jersey’s Smoke-Free Air Act, under fire from bar owners because it exempts casino gambling floors, goes into effect April 15.

fat and ugliness should be banned as well though, Ill be on board with some legislative tweaking.

i don't smoke so I really don't care either way but if the vice is a taxable money stream for the goverment than whomever should be able to smoke in some places in the outdoors

do they realize how many other things are polluting the air? cigarette smoke should be the least of their worries.

although it pretty much takes all the fun out of it if there are no non-smokers to kill with my second-hand smoke.

I'm sorry, I was mistaken. It's not gas they use to kill the smokers, it's tobacco smoke. One grand finale to go out with a room full of blissful smokey goodness.

Hmmm.. and maybe we should ensure that all non-smokers ride bicylcles to work.... Has anybody tried blading on Lakeshore lately?? Those car fumes are deadly!!! I want no car fumes anywhere near the sidewalks or parks!!!! Goddammit!!

I do bike to work. Last summer I biked to work everyday on the lakeshore.
Now if your trying to say all gas emitting cars should be banned from public places I'll jump on that bandwagon too! :p

We shoud be like Amsterdam (more ways than one..hehe!!). No cars in the best parts of the city..lol :)

Yes I've been saying we need a Red Light discrict also for a long time. Amsterdam knows.

LOL.. Don't think I could fully support the Red Light District idea here, but when I went to Amsterdam it was kind of fun walking down the streets. My sister and I pretended we were lesbians and would make comments about the girls we saw.. and had a hoot!!

....Until we saw a girl that looked all of 13 and there were about 6 guys lined up outside her 'window'.. At that point we felt ill and had to leave. It just took on a really dark side we weren't expecting.. Apart from that one experience though, I did love Amsterdam and still do..

As of May 10th (?), you can't... Depends on overhangs and number of umbrellas.. Crap, I don't know, could depend on the number of cats in the neighbourhood...
