I am fucked and getting deported and fuck you korea

I have been working in korea for these past 4 months and i finally had enough of it so i submiited my letter of resignation stating that my mother is sick and that i need to return home. In korea you have to give 1-2 months notice and so i did this and said that i should be back in canada for august at the latest.

However, they have responded by stating that unless i can provide a medical note from a medical professional that they are going to fire me and deport me this friday. They dont believe my story and because they are upset that i am breaking my contract that they are going to fire me. I was like what the fuck i just want to go home to see my family and i dont liek being here like what is the problem. Like cant your understand that.

The major issue here is that i was budgeting to leave this place for august at which point i would of had enough money to return home. If they fire me this friday i am going to be fucked. They paid for my flight here which cost 1,000 dollars and they now have a rental deposit of mine worth 800 dollars. Normally they are supposed to give you that money back. But this company has said that they are going to hold on to it for 2 months. So bascially i dont even have enough money to return home.

fucking hell this whole thing has been one massive fucking nightmare. Even when when in leaving it is a nightmare. I could of just up and left and fucking took my last pay cheque but i was trying to be nice to them so they could find someone else to replace me and this is thier response.

Honestly, these past 4 months have been a fucking nightmare and I am at some level glad i am going to be out of here.

FUCK YOU korea you were a horrible fucking nightmare that i would not wish on my most hated enemy.

so yer mad because they're mad because you want to break a contract you signed? and they're demanding proof for the reason you're breaking you're contract. not sure if korea is the problem here.

This other guy did the same thing two months ago and there was no problem.
honestly whatever like i just want to go home. Like why cant they just let me leave here in peace.

Honestly, like it does not matter why i want to leave. Like i am not a fucking slave here and i went through the appropiate process. i gave them more than enoguh notice and this is how they are treating me. In canada if you said you want to quit your job that would be it. Like people would understand. God all i want to do is leave this place and i was trying to be nice to them for fuck sakes.

I cant get over this.

well there's a reason some jobs ask you to sign a contract. so you'll actually fullfill it. especially jobs where someone is working out of country.

if your mother really is sick why not just provide them with the doctor's note they asked for? why is this a problem ?? it just might be your ticket out of your contract.

well yer probably not the first person to get home sick and want to walk away from a contract. if i were in their shoes not sure how much compassion i would show to be honest.

so about this doctor's note. if that's all they want why not have it faxed over?? if this might solve everything why not just do it??

Ok so i am not totally screwed and my friend has found a company who will hire me and pay for a trip to japan and i can be living up in daejon inside of a week.

man this is great news. I was seriously freaked. This company i work for honestly they are so nuts. Like who fires a worker when they give them thier notice of resigination. So stupid.

going to get it done ASAP. oh well perhaps this is actually better than toughing it out at this stupid job for another month. I can be working at a better job and enjoying life as early as next monday if i want to.

I know but.......i wanted to get a release letter so i could come back here at some point. Everyone told me that short of a family memeber dying they are not to willing to let anyone break a contract. So it seemed logical and at the time well i dont know i have been so stressed out here perhaps i have not been thinking straight.

My understanding is this:

There are two important 'permissions' required in a country:

1. landing permission
2. visa

In some countries (canada, the US, many others) these things are one and the same. In other countries (Japan, many others) these things are separate.

The landing permission allows to just get off the plane (boat, raft, transporter..) and stick around for x amount of time.

The visa permits you to work in a certain field.

Unless you are talking about working in the US under specially TN visas or other nafta crap, your visa is probably not employer specific. That is, just because you get fired or quit or your contract expires, does not mean you are now legally invalid to work. An easy way to check this is to open your passort: your visa will clearly indicate either an expiry date, or the company that you work for (and an expiry date). If, for example, it only has a vague category description, something to the tune of: "category E: international and humanitarian services specialist" then there is (probably) no legal reason that you can't just up and change jobs.

If you, unfortunately, have a visa that is specifically tied to your exployer, which will be clearly indicated in your passport, then you may be out of luck as far as working anymore in Korea is concerned, but it doesn't automatically mean you have to leave ie. be deported. CHeck your landing permission and see for how long it is valid. In all likelihood you are still permitted to remain in Korea.

I'd say 99% chance there is no compelling reason why you aren't allowed to continue working and staying in Korea until your 1 year from entry is up.

However, if your work has organized your apartment you are probably fucked anyways, as it'll probably be tricky to sign a normal Korean lease on your jacks.

As for getting your deposit back, well... I bet you're out of luck. But they may just want to keep it in order to ensure you have paid your utility bills (which you probably wont) or to make sure there are no damage/deposit issues... who knows, you might actually see that money if you are persistent. Korea isn't that sketchy.

Otherwise you really should check foreign affair's website for consular advice.

On that note I believe, before you went, I pointed out to you that Korea is the only country where foreign affairs has posted a warning about teaching English.

ps: the release letter is bullshit. It doesnt apply to foreigners.
The release letter is just a letter form your previous employer which says you no longer work at the original company anymore.
You need this document if you plan to apply to "legitimate" companies under the same sort of rules as normal Koreans.
ie. if you were joe Korean, and wanted to be a designer at Samsung or something, you'd have to have this letter saying you no longer work at Samsungs arch-rival Kimchee-happy-phone. Clearly this document has nothing to do with returning to Korea, or, frankly, getting another job as an English teacher, so don't let your employers scare tactics bother you

also, they will probably deduct the price of your original plane ticket out of your $800 deposit so kiss that goodbye i'd say

what I said about visa's isn't entirely true -- but true enough if you haven't filed for extension of either -- which you haven't, cause you never stick around long enough for anything to expire.

You'll notice it permits you for a "period of sojourn", not "employment at company xyz"

Unless I'm gravely mistaken, which I've been many times in the past, you are certainly not going to get 'deported'.

Anyways, enough people before you have "fucked up" or "been fucked up" in Korea, that your pleasant government has actually put all this important information online for you. And your trusty buddy has actually made it easy and is putting the link here to:

well to be fair in this situation i pretty much had no choice. In order to get a release letter pretty much everyone has told me that you need a major crisis like a family emergency. I found out the real reason why i got fired though today. While walking up the street i saw some of my workers and they were like " hey dont sweat it william. Now that interview in osaka will be a lot easier". I was like "what did you say?". I had not told anyone about this interview i have in osaka. The only person who could of found out was my roommate when he over heard me chatting on the phone to my dad about it. he obviously told the girls at work who hate me and since they already tried to get me fired once i am sure they told my boss this. So when she got my letter of resignation i am sure she was like well ok we are going to beat you too it and they are firing me.

Honestly, if you don't want to be a "fucking slave", don't work in Asia. You obviously didn't do your research if you honestly thought their work ethic is 9-5. My brother in law and his gf are in Korea as well, same issue as yours, working past 5. They got screwed out of a month's paycheck, but it was a lesson they paid dearly for.
