Can Cops Give You A Ticket?

FOR SPEEDING IF THEY ARE GUNNING YOU FROM PRIVATE PROPERTY?

I got a ticket earlier this year and the cop was in a gas station parking lot, well hidden near the back with a radar gun. Me and another car passed by and he stopped me and issued a ticket,
will this ticket stand up in court?

I didn't think it was legal for them to use private property to pinch speeders.

Maybe if they ask permission from the owner, then they could do it? >shrug<

I doubt it matters where they are when they witness a "crime" being committed.

Although if they baited you into speeding and you could prove it...then you're safe.

Otherwise, you just gotta pay.

Yeah, this is pretty standard practice.

There's a used car lot on Highway 27, right before you hit Rexdale Blvd where they hole up with their donuts and their guns. You can't see the car in the midst of all the others. Fairly notorious speed trap, that one. It's been there for as long as I've been driving.

If it's private property the owner has to give permission. As long as they're given the go ahead, you can't really argue where the cop was sitting at the time you were clocked.

Q. The officer wasn’t on the street but was on private property. Is he allowed to do this? Is this considered trespassing and does it affect the ticket?

A.

1. The officer can write speeding tickets or set up radar on any location he wants. If the property owner came out and asked the officer to move off his property the officer would have to do so. It does not affect the validity of any speeding ticket or traffic ticket.
2. The property owners consent or lack thereof is NOT vital to the case.

he sure can issue the ticket..but it wont hold water in court. see him there, wear your bestest suit and prepare to leav smiling

Just an FYI speeding is not a criminal act, it's considered a quasi crime and a violation of the HTA, also there are guidlines with regards to speed traps, they're just not readily available

were you speeding? if you got caught speeding, why shouldn't you have to pay for it???

According to the cop I was, but he gunned another car not mine. He only stopped me because I was closer to being caught and the other car was a Mercedes and mine was a VW, he assumed I was a young guy.

I was in the curb lane doing 5 over, he tagged me doing 20 over and knocked it down to 5 over. He also told me it had no affect on insurance, I corrected him and gave him my card.

Happens all the time...

do you drive or were you just adding your pennies?
