What did you sign in your employment contract?

I'd have to know the working times and off-time of each of your shifts in those 22 days to tell you whether or not what they're doing is against the ESA, but for the most part:

a) you need an 11 hour free from active duty each day(unless you're on call and are called in)

b) 8 hour rest period b/w shifts (unless you're not working a shift longer than 13 hours)

c) at least 24 hours (consecutively) off every week

OR

d) 48 hours (consecutively) off in every two weeks.

Also you shouldn't be working more than 60 hours per week unless you've specifically signed an employment contract agreeing to those conditions. Most employers don't bother doing that though.

There are a couple of ways that employers can get around these rules, although they're supposed to be inflexible. AFAIR an employee can't even sign away the rights to time off between shifts (but I could be wrong).

They're paying you for the time you're in (OT at the appropriate rates) AND they're paying you for their training which may be a requirement for your job (is it H&S training?).

Just call the ESA office in Toronto, explain the sitch and ask 'em.

BTW, all that shit I posted above is from my head/notes. It may not be right.

IBM is king of CYA (cover your ass).. they made me sign that sheet twice... once i worked 80 hours in one week and my manager and i got a form from legal dept or something saying i did the hours willingly and i won't sue or some crap...

Jake: a) I am looking for a job now... most jobs posted for the field i'm going for usually get taken by friends of people who work at the company.. they are those kinda of 'need to know someone' jobs cause they're the goods.... but I am lookin.. and i'm a longterm person.. i won't change jobs unless its into another career job.

b) i paid all my tickets at the beginning of the year.. these are new ones and i do have a permit however I can't get it switched to the new area i'm living in until I get something in the mail with my address.

I got stung by a wasp on the tip of my thumb. I was trying to catch it and get it out of the house last night.

It's real interesting to feel the poison go through my body... the throbbing pain... it did hurt... but not so bad. I thought it was kindof interesting to analyse it.
