Five Alarm Funk is a horn powered, percussion fuelled sonic and visual assault. For more than six years the band has brought their relentless and unforgettable live show to clubs and major festivals across Canada and the United States. The band on stage is an unstoppable orgy of energy. Ten musicians perform intricate and airtight arrangements with delirious dance moves and full on headbanging. Choreographed arm movements coincide with melodic climaxes while the four percussionists create a true spectacle.<br />
<br />
Five Alarm Funk's third studio album Anything is Possible was released July 2010. The genre-spanning, groove-straddling opus reveals 14 tunes of unbridled energy. The first track, Infernal Monologue, begins with an angelic children's choir before quickly moving into classically inspired heavy prog-rock. From there the party gets started with some straight-ahead funk on Zenith Escalator before turning to driving world-rhythms and burning middle-eastern inspired horn lines on Titan. Influences as diverse as Frank Zappa, Yes, J.S. Bach and Antibalas all make an appearance before Anything is Possible is finished. Chartattack calls it &quot;a potent mind altering substance&quot; and gives it a rating of 4.5 out of 5. The album charted as high as #16 on the national college radio chart.<br />
<br />
From over 300 Five Alarm Funk shows some highlights include: Vancouver Jazz Festival, Toronto Jazz Festival, Ottawa Blues Fest, Shambhala, Sunfest in London Ontario, Ness Creek Festival in Saskatchewan, Summer Meltdown in Washington, the Keelung Mid-Summer Festival in Taiwan, and numerous sold-out shows at the Commodore Ballroom in Vancouver.<br />

Recently the band had a number of performances for the Vancouver/Whistler 2010 Olympic games. Minutes after Canada was awarded the gold medal in hockey Five Alarm Funk took the stage at the Hockey House and performed to a delirious crowd.<br />

After Funk brings together aspects of both modern and classic popular music to create a unique sound that cannot be easily replicated. It is now common for employees to have access to the Internet at work. Many use the Internet for personal reasons during work time. Many employers are concerned about the loss of productivity resulting from excessive personal use of the Internet. <br />
<br />
A number of employers have attempted to characterize excessive personal Internet use as “time theft”, as a result of the work hours lost. This is a concept historically used to describe situations when employees claim to be at work but are not. <br />
<br />
Two recent arbitration cases looked at this issue.<br />
<br />
In Andrews v. Deputy Head (Department of Citizenship and Immigration) (August 2011) (PDF), an investigation revealed that the employee, Franklin Andrews, spent ½ to ¾ of his workday using the Internet for non-work-related purposes, for significant periods of time in 2008 and 2009. Much of Andrews’ browsing time was spent viewing pornography.<br />
<br />
During the investigation, Andrews was cooperative, remorseful and admitted to the significant amount of time spent on personal Internet use. He claimed that he did not have enough work to do. He had a clean disciplinary record, 27 years of service, stellar performance reviews, and consistently met his deadlines.   <br />
<br />
The employer discharged Andrews for cause. At arbitration, Andrews again acknowledged his wrongdoing. He argued that dismissal was a disproportionate reaction. The employer argued that Andrews had committed time theft, as he “sat at a desk surfing the Internet for half the day, day after day and month after month, claiming pay for time not worked…”. It argued that discharge was appropriate.<br />
<br />
The Adjudicator ruled that Andrews’ actions did not amount to time theft.  Personal use of the Internet was permissible at work, and time and working hours were not actively recorded. She stated that time theft involves a fraudulent intent to deceive the employer. This fundamental element of a fraudulent intent was not found on the facts of this case. However, Andrews still bore some blame.<br />
<br />
Andrews was reinstated without back pay by the Adjudicator. This was due to his cooperation, remorse, acknowledgment of guilt, and significant mitigating factors. <br />
<br />
In Health Sciences Association of British Columbia v. Health Employers' Association of British Columbia (October 2011) (PDF), Vic Cheema was dismissed for cause because of excessive personal Internet use in breach of employer policies. As in Andrews, the employer considered Cheema’s actions to constitute time theft. <br />
<br />
The Arbitrator did not accept the employer's characterization, noting that Cheema was at the office during the relevant periods and responded to all workplace demands promptly and efficiently. The Arbitrator chose to characterize Cheema’s actions as a &quot;productivity issue, rather than theft.&quot; He observed that while &quot;[w]asting time on a job can certainly be subject to discipline even discharge,&quot; in this case, the conduct did not amount to time theft. <br />
<br />
The Arbitrator described time theft as having a &quot;quasi-criminal nature&quot;. He noted that there was no &quot;clear and convincing evidence&quot; of Cheema using the Internet for personal reasons when he should have been working on preventative maintenance. This is similar to the lack of &quot;fraudulent intent&quot; required to make out the charge of time theft noted in Andrews. <br />
<br />
The Arbitrator substituted a 15-day suspension for the termination. <br />
<br />
<b>Lessons Learned</b><br />
<br />
In both cases, the employees responded to workplace demands in a timely manner and had positive performance reviews. This ability to respond to workplace demands and the lack of intention to defraud the employer led to the arbitrators finding that excessive personal Internet use did not amount to time theft. <br />
<br />
The cases do highlight the need to have clear policies in order to be able to rely upon these policies to uphold a termination. In the Andrews case, the employer implemented policies relating to inappropriate Internet use, but did not specify what would constitute excessive use warranting discipline. This lack of specificity can make it difficult to justify termination, particularly in the case of a long service, high performing employee. Employers should review their Internet use policies to determine whether their organization’s expectations are clearly laid out for their employees.</div>

My first reaction was, in my head:<br />

And my second reaction was to go somewhere else.<br />

i seem to remember he always had a towel hanging from the butt of his pants.<br />

right now i'm picturing him up on the east side stage at the docks, but i know that i used to see him at lots of places.<br />

my husband and i were just trying to remember who this guy was. but our memories are obviously a little vague.</div>

<ul><li>I would like to be able to read .pdf or other book files I have downloaded as torrents for example.</li>
<li>I want to be able to read purchased content if I want from Amazon.</li>
<li>I also want to be able to use the book files the Toronto Public Library makes available.</li>
<li>The screen should be easy to read in bright light - like on the beach.</li>
<li>It has to be solidly built, not like those cheaply made plastic readers I see at Indigo/CHapters for sale.</li>

TORONTO — Police violated civil rights, detained people illegally, and used excessive force during the G20 summit two years ago, a new report concludes.<br />
<br />
The report by Ontario’s independent police watchdog also blasts the temporary detention centre that Toronto police set up for its poor planning, design and operation that saw people detained illegally.<br />
<br />
The Office of the Independent Police Review Director found police breached several constitutional rights during the tumultuous event, in which more than 1,100 people were arrested, most to be released without charge.<br />
<br />
“Some police officers ignored basic rights citizens have under the Charter and overstepped their authority when they stopped and searched people arbitrarily and without legal justification,” the report states.<br />
<br />
The 300-page report, which provides a detailed look at the events that weekend, finds that protesters were not the only ones who resorted to violence.<br />
<br />
“Numerous police officers used excessive force when arresting individuals and seemed to send a message that violence would be met with violence,” the report states.<br />
<br />
“The reaction created a cycle of escalating responses from both sides.”<br />
<br />
The report takes aim at police tactics at the provincial legislature, which had been set up in advance as a protest zone. It says the force used for crowd control and in making arrests was “in some cases excessive.”<br />
<br />
“It is fair to say the level of force used in controlling the crowds and making arrests at Queen’s Park was higher than anything the general public had witnessed before in Toronto.”<br />
<br />
It also concludes mass arrests outside a downtown hotel were “unlawful,” and a dawn raid and arrest of people at a university residence was done without the required warrants.<br />
<br />
Police penned in hundreds of protesters at the corner of Spadina Avenue and Queen Street in Toronto during the summit, and made many arrests despite no violence.<br />
<br />
The office, under director Gerry McNeilly, slams police for “kettling” scores of people — many passersby — at a downtown intersection for several hours in a severe thunderstorm, calling it “unreasonable, unnecessary and unlawful.”<br />
<br />
Even officers in place thought the situation untenable, with one describing the incident commander as “maniacal,” the report says.<br />
<br />
“Where are they going to give them a chance to disperse?” one officer asked.<br />
<br />
“They aren’t, that’s the problem,” another replied.<br />
<br />
“Well, that’s stupid.”<br />
<br />
In regard to the temporary detention centre, the report criticizes senior officers for failing to take adequate steps to address problems.<br />
<br />
Among complaints were overcrowding, lack of food and water or access to lawyers, the use of flex cuffs and strip searches. Detainees had to use toilets in full view of others and many were held illegally.<br />
<br />
Because of shoddy paperwork, it is impossible to state accurately the number of people who were arrested over the course of the summit weekend, the report says.<br />
<br />
The report makes 42 recommendations.<br />
<br />
Among them, it urges changes to the Police Services Act and police code of conduct to oblige officers to disclose potential evidence of misconduct.<br />
<br />
<b>“Senior officers especially should not condone or distance themselves from the misconduct of subordinates or colleagues.”<br />
</b><br />
It also urges governments to provide enough time for planning and preparing large-scale security operations, both of which were sorely lacking in this case given the “wholly inadequate” four months police had to plan.<br />
<br />
“Although insufficient time was certainly a factor, the operational planning committee should be faulted for the decision that it would be ’business as usual’.”<br />
<br />
In all, the report slams Toronto police, who had the lead in keeping order outside the summit security zone and were responsible for the detention centre, for poor planning and serious gaps in communications.<br />
<br />
The incident command centre, set up for overall police control, had “no idea” how many officers were working.<br />
<br />
Police often failed to give crowds proper directions to disperse, leading to confrontations and increased tensions.<br />
<br />
It also faults the incident commander for referring to the crowds at one point as “marauding terrorists,” creating the impression that criminals were on the loose.<br />
<br />
The findings follow on the heels of a similar report this week by the RCMP complaints commissioner.<br />
<br />
That report found the Mounties had by and large acted reasonably but faulted poor co-ordination among police.<br />
 <br />
The June 2010 summit was marred by vandals who smashed windows and set police cruisers on fire as well as by mass arrests, including of innocent bystanders.<br />
<br />
The function of the Office of the Independent Police Review Director — an arms-length civilian agency — is to process and oversee the investigation of public complaints against police or, in some cases, investigate a public complaint itself.<br />
<br />
McNeilly said he decided it was in the public interest to combine a total of 356 complaints related to the G20 and do a systemic review of municipal, regional and Ontario Provincial Police involvement.<br />
<br />
Numerous individuals and groups, including the Canadian Civil Liberties Association, have lambasted police for riding roughshod over people’s rights.<br />
<br />
Several civil suits alleging police brutality and violations of rights have also been launched against Toronto police and other agencies involved in the summit.<br />
<br />
Earlier this year, McNeilly recommended charges against five police officers for the beating of G20 protester Adam Nobody at the legislature.<br />
<br />
